We want to concentrate on two of the elements, two counts of aggravated sexual abuse of a child, a first-degree felony; four counts of sodomy on a child, a first-degree felony.

First let us look at what Allan has been claiming for years ever since his confessions. In Allan’s article “I Didn’t Pass the Lie Detector Testing,”  Allan stated –

“On the spectrum, I’m on the end of having just crossed over the line – nowhere close to the dark end of the spectrum.”

Allan wanted everyone to believe that what he did was very minor, maybe just a little touching or something. But look at this charge, “four counts of sodomy on a child, a first-degree felony.”

First of all we now know the maximum age of the girls Allan molested — 13 years old.
“Under Utah law, a child is defines as a person under the age of 14 years.”

On the website – where Utah laws are posted we read –

Title 76  Chapter 5  Part 4  Section 403.1

Allan Arrested - 4You will note section (4), Imprisonment under this section is mandatory in accordance with Section 76-3-406, so it looks like Allan will be going to prison if convicted.

Here is Section 76-3-406 –

Allan Arrested - 6Allan Arrested - 7It would seem by reading these two sections of code the sodomy charge involves an act that is more than just touching the victim, where the charge of aggravated sexual abuse could consist of only touching the victim. Since both charges involve mandatory imprisonment we anticipate Sterling D. Allan, if convicted, will be going to prison for maybe the rest of his adult life or at least a large portion of it.
